Internet solicitation and crimes: Florida takes new legal measures

The growth of the net and it’s use by children and teen could be very dangerous for them. It is confirmed by many study and cases that Internet solicitation of the young people is becoming a big problem connected to the numerous of information and the communication with unknown people. To face the problem, the State of Florida has put in place laws with the purpose of reducing the risk of Internet surfers becoming victims of such online solicitation.

 

5868477998_2979be7f52First of all, what is a Solicitation? In the legal dictionary there is an explanation: “Urgent request, plea, or entreaty; enticing, asking. The criminal offense of urging someone to commit an unlawful act.

The term is used in a variety of legal contexts and many solicitations in everyday life appear to be legal. For example, a telemarketer who tries to sell a legitimate product by calling potential customers is making a solicitation. It may or may not be legal, however, depending on the laws of the states where the telemarketer and the caller reside.

Criminal solicitation commonly involves crimes such as prostitution and drug dealing, though politicians have been convicted for solicitation of a bribe.

But now we face another type of act, of conduct.

In fact in the modern age of computers there is an endless list where law enforcement can trap its next victim in a computer internet sex sting operation aimed at sex crimes: text messaging, sexting, Twitter, Facebook, Myspace, Craigslist, AOL, Gmail, Hotmail, Google, Bing, Yahoo and Droid and iPhone use.

Most of them are simple teens and kinds, especially females.

So what did the state of Florida?

Recently there has been a new enforcement, a legal one which  has  made the law stronger against these Internet solicitation: in the specific the law in Florida prohibits the use of computer services, devices, or the Internet for the purpose of illegal solicitation. As to have a better explanation, some Criminal lawyers gave some tips and advice  that “any individual who uses an Internet service, computer online service, local bulletin board service, or any such device that is capable of storing or transmitting electronic data to solicit, seduce, entice or lure, or make an attempt to solicit, seduce, entice or lure, a child, or another individual assumed by the individual to be a child, with an aim to commit any unlawful act or unlawful sexual conduct, will be charged with a felony of the third degree.”.

It means by up 5 years in jail.

Reading the law text there is also written “If such individual even entices or lures a custodian, legal guardian or parent of a child or a person assumed to be a custodian, legal guardian or parent of a child to agree to the

participation of such child in an unlawful act or unlawful sexual conduct, he or she will still be charge in the same manner. If the person who is committing this unlawful solicitation misrepresents his or her age, the person will be charged with a felony of the second degree”.

Also meeting a minor can turn in to bad, in fact “If an individual travels any distance within the state of Florida, to the state of Florida, or from the state of Florida, by any means, or makes an attempt to do so, or causes another person to do so for the purpose of committing an illegal act as defined under chapters 794, 800, and 827, or otherwise becomes involved in unlawful sexual behaviour with a child, or with another person assumed to be a child following the use of an Internet service, computer online service, local bulletin board service, or any other device that can store or transmit electronic data, will be committing a felony of the second degree punishable by up to 15 years in prison.”.

Conclusions

It is absolutely forbidden thinking that it has been unnecessary. With the growth of technology, the risks are increasing, especially for those who are weaker: kids and teens at first.

Nowadays we hear many of these cases and many other haven’t justice. Without Internet the communications were difficulties and people made their deal with the neighbour. Now a teenager from Alaska can communicate with an old bad man in South Afrika.

We have to take the right measure for the right crime. We should protect the users of the net and for the weaker the State of Florida has seen that it has been necessary another weapon near the parental control: the State control.
